A non-refundable retainer fee of $500 is due when this agreement is signed, in order to reserve the event date. The remaining balance is to be paid no later than the day of the photo shoot. Any and all applicable travel fees must be paid before the session date. No final images will be delivered without the full payment received.

Reservation
A signed contract and the retainer fee must be returned to The Family Lab (TFL) within 5 BUSINESS DAYS of receiving to officially reserve the date specified above. If not received within 5 business days TFL reserves the right to give the date/time to another party.

Cooperation & Communication: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this session. Communication is an essential part to ensure a positive experience and the best possible quality of product. If on location, TFL seeks to find the best lighting and conditions possible within the scope of the location to ensure beautiful photographs. Please contact SSP with any questions, comments, concerns or ideas as soon as they arise.


Copyrights: The photographs produced by TFL are protected by Copyright Law (all rights reserved) and may not be reproduced in any manner without TFL's explicit written permission. Personal use rights will be distributed after the balance is paid in full. Upon distribution or online web gallery, limited copyright ownership of the resulting images will be transferred to the CLIENT under the following conditions:
. THE CLIENT must obtain written permission from, and compensate TFL prior to an event where THE CLIENT, THE CLIENT’S friends or relatives publish or sell the photographs for profit.

In case the client wishes to keep the photographs private a new non-disclosure contract will be created and additional %20 will be added to the initial fee.

Model Release: The CLIENT hereby grants TFL and its legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs of the CLIENT or in which the CLIENT may be included, for editorial, trade, advertising and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same. The CLIENT hereby releases The Family Lab and its legal representatives and assigns from all claims and liability relation to said photographs.

Limit of Liability: In the unlikely event that the photographer is injured or becomes too ill to photograph the event,TFL will make every effort to secure a replacement session date. If the situation should occur and a suitable date is not found, responsibility and liability is limited to the return of all payments received for the event.

TFL takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event those photographs have been lost, stolen, or destroyed for reasons within or beyond TFL’s control, TFL liability is limited to the return of all payments received for the session package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. TFL is not responsible for any damages, injuries or other incidents during or in transportation to and/or from a scheduled session or meeting.


Rescheduling policies & procedures:
TFL is not responsible if the CLIENT and/or key individuals fail to appear or cooperate during portrait sessions, or for missed images due to details not revealed to Photographer. If the CLIENT and/or key individuals fail to appear to a scheduled portrait session, the $400 retainer fee is non-refundable. The session can be rescheduled at the original portrait session fee. If the CLIENT becomes ill or an emergency arises, please contact TFL as soon as possible. A $100 rescheduling fee may be applied if rescheduling requests are received less than 48 hours in advance.

Cancellation:
In any event, including cancellation, the $500 retainer fee is non refundable. The CLIENT shall also be responsible for payment for any SSP material charges incurred up to time of cancellation.

Tardiness:
In the event that the CLIENT is late to the appointment set, the CLIENT’s session will still be for the same scheduled ending time, therefore directly and indefinitely affecting the number of images received. SSP is not responsible for delivering promised quantity due to time constraints placed upon the session due to the CLIENT.

Weather Policy:
In the event of weather conditions that are out of our control: If the CLIENT has been contacted and advised to reschedule due to the photographer’s concerns about weather, and the CLIENT still proceeds with the session, certain circumstances in weather (rain, snow, darkness) will limit the time and or photos that were able to be taken, the CLIENT will be charged for an additional session at the photographer’s hourly rate to reschedule or shoot additional photos if necessary. It is up to TFL’s discretion if bad weather persists to cancel the session before or during the session. CLIENT will not be charged to reschedule at SSP’s decision.

Locations:
If the CLIENT requests more than one location for the session, the travel time going from destination 1 to destination 2 and so forth does count towards the total amount of the session time. Fees may apply, starting at $25. Contact TFL to discuss locations and travel fees. If the CLIENT wants to do a session at a location that charges for access, the CLIENT will be responsible to cover fees associated with shooting there, and all parking fees. They are also responsible for organizing the access and any permits related to doing so.

Overtime:
If the session runs into over time the client agrees to an overtime rate of $300 per half hour. Overtime coverage must be agreed upon by both parties before TFL continues event coverage. 

Processing & Completion:
Digital processing takes approximately 5 to 6 weeks, depending on the TFL’s work schedule If it will exceed that time frame, you will be notified by TFL. RUSH orders may be made available starting at $500. Requests for additional and specific retouching will be considered (but not guaranteed) starting at $5/photo or $75/hour (no services will be rendered until payment is made in full). TFL takes a natural and semi-photojournalistic approach to portrait sessions, and works hard to bring CLIENTs to the best light and produces the best possible photographs in-camera with the provided circumstances. TFL does not do extensive editing (heavy touchups, body reshaping, braces removal, composite shots/head swaps, etc.).


Archival:
The client agrees to archive the images and update them with the newest technologies after delivery. TFL is not responsible for archiving images.
