A non-refundable retainer fee of $500 is due when this agreement is signed, in order to reserve the event date. (The deposit is non-refundable, but goes towards the initial fee - it is designed to reserve the time and the studio space. In case of rescheduling a new deposit will be charged and does not go towards the initial fee) The remaining balance is to be paid no later than the day of the photo shoot. Any and all applicable travel fees must be paid before the session date. No final images will be delivered without the full payment received.

Reservation and Payment
A signed contract and the retainer fee must be returned to The Family Lab (TFL) within 5 BUSINESS DAYS of receiving to officially reserve the date specified above. If not received within 5 business days TFL reserves the right to give the date/time to another party.

The final balance must be payed 3 days prior the session or the day off (remaining $1360 after paying the $500 deposit - making the whole fee $1860)

Cooperation & Communication
The parties agree to cheerful cooperation and communication for the best possible result within the definition of this session. Communication is an essential part to ensure a positive experience and the best possible quality of product. If on location, TFL seeks to find the best lighting and conditions possible within the scope of the location to ensure beautiful photographs. Please contact TFL with any questions, comments, concerns or ideas as soon as they arise.

Copyrights
The photographs produced by TFL are protected by Copyright Law (all rights reserved) and may not be reproduced in any manner without TFL's explicit written permission. Personal use rights will be distributed after the balance is paid in full. Upon distribution or online web gallery, limited copyright ownership of the resulting images will be transferred to the CLIENT under the following conditions:
THE CLIENT must obtain written permission from, and compensate TFL prior to an event where THE CLIENT, THE CLIENT’S friends or relatives publish or sell the photographs for profit.

As this is a non-disclosure contract additional %20 were added to the main fee of $1550 ( new balance $1860) and TFL agrees to not publish or share the CLIENTS photos on any platform, trade or advertising - online or printed. The CLIENT reserves all the rights of the photographs after the balance is paid. The photos will be delivered on a password protected online gallery. The deposit fee remains the same


Limit of Liability
In the unlikely event that the photographer is injured or becomes too ill to photograph the event, TFL will make every effort to secure a replacement session date. If the situation should occur and a suitable date is not found, responsibility and liability is limited to the return of all payments received for the event.

TFL takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event those photographs have been lost, stolen, or destroyed for reasons within or beyond TFL’s control, TFL liability is limited to the return of all payments received for the session package. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals. TFL is not responsible for any damages, injuries or other incidents during or in transportation to and/or from a scheduled session or meeting.

Rescheduling policies & procedures
TFL is not responsible if the CLIENT and/or key individuals fail to appear or cooperate during portrait sessions. If the CLIENT and/or key individuals fail to appear to a scheduled portrait session, the $500 retainer fee is non-refundable. The session can be rescheduled at the original portrait session fee. If the CLIENT becomes ill or an emergency arises, please contact TFL as soon as possible. A $150 rescheduling fee will be charged and does not go towards the initial fee


Cancellation
In any event, including cancellation, the $500 retainer fee is non refundable. The CLIENT shall also be responsible for payment for any TFL material charges incurred up to time of cancellation.

Tardiness
In the event that the CLIENT is late to the appointment set, the CLIENT’s session will still be for the same scheduled ending time, therefore directly and indefinitely affecting the number of images received. TFL is not responsible for delivering promised quantity due to time constraints placed upon the session due to the CLIENT.

Overtime
If the session runs into over time the client agrees to an overtime rate of $300 per half hour. Overtime coverage must be agreed upon by both parties before TFL continues the coverage. 

Processing & Completion
Digital processing takes approximately 4 to 5 weeks, depending on the TFL’s work schedule. If that time frame will exceed, you will be notified by TFL. TFL takes a natural, semi-photojournalistic approach with an editorial touch to portrait sessions, and works hard to bring CLIENTs to the best light and produces the best possible photographs in-camera with the provided circumstances. TFL does not do extensive editing (heavy touchups, body reshaping, braces removal, composite shots/head swaps, etc.)

Archival
The client agrees to archive the images and update them with the newest technologies after delivery. TFL is not responsible for archiving images.
